These Terms of Service ("Terms") govern your access to and use of the Cinder mobile application, website (including www.joincinder.com), and related services (collectively, the "Services") operated by Cinder Coach LLC ("Cinder," "Company," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use Cinder.

By using the Services, you represent and warrant that:

  • You are at least 18 years old

  • You reside in a jurisdiction where use of the Services is permitted

  • You will comply with all applicable laws

2. Description of Services

Cinder provides financial awareness and confidence tools designed to help users understand safe-to-spend amounts, projected bill impacts, and related financial insights.

Cinder:

  • Is not a bank

  • Is not a financial advisor

  • Does not provide investment, tax, accounting, or legal advice

  • Does not guarantee financial outcomes

All information provided through the Services is for informational and educational purposes only.

You are solely responsible for your financial decisions.

3. Account Registration & Security

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information

  • Maintain the confidentiality of your login credentials

  • Notify us immediately of unauthorized access

You are responsible for all activity under your account.

Cinder Coach LLC is not liable for losses caused by unauthorized use of your account.

4. Bank Account Linking (Plaid Integration)

Cinder uses third-party service providers, including Plaid Inc., to enable secure financial account connections.

By linking a financial account:

  • You authorize Cinder and its service providers to access financial data on your behalf

  • You acknowledge that Plaid services are governed by Plaid’s own Terms and Privacy Policy

  • You understand that Cinder does not store your bank login credentials

Cinder stores only limited financial metadata and encrypted access tokens as necessary to provide Services.

We are not responsible for the performance, availability, or data practices of third-party providers.

5. No Financial Advice Disclaimer

The projections, confidence scores, and safe-to-spend calculations provided by Cinder:

  • Are algorithmic estimates

  • May not reflect real-time account balances

  • May contain inaccuracies

  • Should not be relied upon as your sole source of financial guidance

You should consult qualified financial professionals before making significant financial decisions.

6. User Conduct

You agree not to:

  • Use the Services for unlawful purposes

  • Attempt to reverse engineer, decompile, or exploit the software

  • Circumvent security measures

  • Access financial accounts other than your own

  • Interfere with the operation of the Services

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Data & Privacy

Your use of the Services is also governed by our Privacy Policy.

By using Cinder, you consent to the collection, use, and storage of data as described in our Privacy Policy.

8. Service Availability & Modifications

We may:

  • Modify or discontinue features

  • Update functionality

  • Perform maintenance

  • Suspend Services temporarily

We do not guarantee uninterrupted or error-free operation.

9. Intellectual Property

All software, branding, designs, content, and technology associated with Cinder are owned by Cinder Coach LLC or its licensors.

You may not:

  • Copy

  • Reproduce

  • Distribute

  • Create derivative works

  • Use our trademarks

Without prior written permission.

10. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Cinder Coach LLC disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Accuracy or reliability of financial projections

  • Non-infringement

We do not guarantee that:

  • Calculations will be error-free

  • Data will always be current

  • The Service will be uninterrupted

11. Limitation of Liability

To the fullest extent permitted by law, Cinder Coach LLC shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Financial losses

  • Lost profits

  • Data loss

  • Business interruption

Our total liability for any claim shall not exceed the greater of:

  • $100 USD

  • The amount you paid us in the past 12 months (if any)

12. Indemnification

You agree to indemnify and hold harmless Cinder Coach LLC, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising out of:

  • Your use of the Services

  • Violation of these Terms

  • Violation of applicable law

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms.

14. Governing Law
